Hazte con todos tus derechos y obligaciones

Pokémon GO lleva poco más de una semana entre nosotros, y únicamente en unos pocos países, pero ya se ha convertido sin duda en uno de los fenómenos del año. De hecho, es ya el mayor juego móvil en la historia de EE.UU. y se acerca rápidamente al nivel de uso de Google Maps y Snapchat. En menos de dos semanas.

El ya clásico concepto de Pokémon consistente en hacerse con los mejores Pokémon en el correspondiente mundo virtual, para luego entrenarlos y competir contra otros entrenadores y en los respectivos torneos, ahora da el salto al mundo real.

Es decir, gracias a la realidad aumentada, los Pokémon ya no viven en un mundo virtual de fantasía, sino que viven y se pasean en el mundo real. Por ejemplo, el jardín del vecino. Gracias a los dispositivos móviles podemos localizarlos (cámara + geolocalización), capturarlos, entrenarlos y competir con el resto del planeta.

De modo que el grado de inmersión e interacción se dispara por las nubes, ya que para hacerse con los Pokémon hay que  físicamente desplazarse hasta los lugares en los que se indica que habitan. Lo que ha generado no pocas críticas por parte de jugadores con discapacidades, que ven muy limitadas sus posibilidades de participación.

Que todo el planeta sea el tablero de juego y uno deba necesariamente desplazarse por él para jugar, ha generado todo tipo de locas historias en estos pocos días que lleva en marcha Pokémon GO:

• Lugares que ya están prohibiendo que la gente vaya a cazar Pokémons
• Parejas infieles delatadas por Pokémon GO
• El alcalde de Río pidiendo que pueda usarse durante los Juegos Olímpicos
• O ladrones y policías beneficiándose a partes iguales de las incursiones de los jugadores

Y esto no ha hecho más que comenzar…

Pero vamos a nuestro tema, ¿qué dicen los términos y condiciones de Pokémon GO? Pues sus Condiciones del Servicio, Política de Privacidad, Política de Copyright y Trainer Guidelines tienen varios puntos llamativos.

¡Vamos a ello!

13 detalles sobre sus términos y condiciones

1.- El acuerdo se firma con Niantic Labs, compañía nacida inicialmente en el seno de Google, que luego se independizaría por allá 2015. En ese momento, y anunciado el desarrollo de Pokémon GO, tanto Google como Nintendo y The Pokémon Company invirtieron económicamente en el crecimiento de la compañía. De modo que ahora las tres participan.

2.- El uso de Pokémon GO es personal y no comercial. Por tanto, ojo esos negocios que lo quieran usar para atraer a clientes, ya que estarían infringiendo las condiciones. Aunque las ubicaciones patrocinadas están en camino.

3.- Al menos hay que tener 13 años para usarlo. Ahora bien, los menores de 13 años necesitan que sus padres se den de alta en The Pokémon Company International vía el Club de Entrenadores Pokémon, indicando nombre del usuario, correo electrónico y fecha de nacimiento. Eso implicaría el consentimiento paterno. Además, los residentes en EEUU deben verificar que son los padres del niño mediante un proceso específico. Desde aquí puede retirarse el consentimiento cuando un padre desee cerrar la cuenta de un menor de 13 años.

4.- Para acceder al servicio se requiere cuenta con Google, con Facebook o con el Club de Entrenadores Pokémon. De esas cuentas se recoge la información personal necesaria (por ej. el email) para generar la cuenta. En el caso del Club, también se necesitará la fecha de nacimiento, el nombre y apellidos. El acceso al servicio por cuentas de terceros, como la de Google, generó polémica en cuanto a la privacidad de Pokémon GO, ya que usar la cuenta de Google implicaba ceder acceso completo al perfil (muchísimo más que el simple email). Algo que en todo caso se arregló a los pocos días.

5.- Los datos recopilados por el juego, en las distintas fases, son: el nombre de usuario o nombre real (en función de lo elegido), los mensajes enviados a otros usuarios, país, idioma, los datos obtenidos vía cookies y balizas (por ej. el tráfico web y uso agregado), la IP, el agente de usuario, el navegador usado, sistema operativo, web de origen, términos de búsqueda, tiempo dedicado, enlaces clicados y muy importante en materia de privacidad, la ubicación (vía GPS, triangulación Wifi o torres de telefonía).

6.- ¿Con quién y cómo se comparte la información recopilada? Veamos un punto básico de su privacidad:

a) Con The Pokémon Company (también la International) se comparten datos personales (de menores de 13 años y adultos) para poder resolver cualquier problema surgido durante el registro. The Pokémon Company International también recopila los datos sobre el consentimiento de los padres respecto a menores de 13 años registrados.

b) Con proveedores de servicios que permiten prestarlo (por ej. el alojamiento web) se comparten datos personales (de menores de 13 años y adultos) para dar el servicio, nada más;

c) Los datos no personales de adultos (quedan excluidos los de menores de 13 años), se comparten para investigación, análisis, creación de perfiles demográficos y otros fines similares;

d) Con un tercero que pueda adquirir la empresa, se comparten los datos personales de adultos y menores de 13 años (en cuyo se avisaría con 30 días de antelación y se daría la oportunidad de oponerse);

e) Con gobiernos, organismos de enjuiciamiento civil (!) o entidades privadas para hacer cumplir la ley, por ej. un proceso legal.

f) En cualquier caso, cabe negarse a la recopilación, uso y divulgación de la información personal (de los menores de 13 años también). Por ej. impidiendo que la información personal de un menor (o adulto) acabe en EE.UU (que es donde se trata y procesa la información personal). Ello debe indicarse en esta dirección: pokemongo-privacy@nianticlabs.com Sin embargo, es muy probable que eso limite casi por completo el acceso y uso de Pokémon GO. Por tanto, es una concesión un poco cara a la galería…

7.- El contenido compartido por el usuario mediante la app se licencia a Niantic Labs de forma indefinida, no-exclusiva, irrevocable, transferible, sublicenciable, mundial y gratuita para hacer y deshacer en casi cualquier modo. Es decir, muuuuuy generosamente.

8.- Los Pokémon obtenidos puede intercambiarse por otros pero dentro del servicio, no a cambio de dinero virtual o real, ni bienes o servicios reales. En cualquier caso, ya hay usuarios online que están montando negocio alrededor de ello (por ej. servicios de “taxi” para llevar a alguien hasta la localización de un Pokémon).

9.- Los micropagos que se hagan dentro del propio juego, que existen, deben ser realizados por usuarios mayores de 18 años o menores de esa edad pero con consentimiento paterno para realizar la compra. Micropagos en los que cabe derecho de desistimiento, pero únicamente hasta que se completa la compra.

10.- Si Pokémon GO no se usa durante 1 año, se cierra la cuenta y se pierde con ello todo contenido relacionado. En todo caso, una cuenta cerrada se conservará por “un tiempo razonable a nivel comercial”. La posible interrupción en el uso del dinero virtual o contenido in-game, se comunicará con 60 días de antelación.

11.- Entre las muchas conductas prohibidas, una importante a tener en cuenta considerando el tipo de juego, es la de intentar acceder un lugar o ubicación en la que no se tiene derecho de acceso. Significativo recordarlo teniendo en cuenta los lugares que ya están prohibiendo el acceso a jugadores de Pokémon GO. De hecho, si alguien quiere que su casa o comercio desaparezca del mapa de Pokémon GO com gym, Pokéstop o quiere denunciar un sitio o lugar que no debería mostrarse en el mapa, Niantic ha puesto a disposición de los usuarios un formulario para ello.

12.- Son responsabilidad exclusiva del usuario las comunicaciones online y offline que tenga con otros usuarios del servicio. De hecho, se dice expresamente que Niantic Labs no investiga ni pregunta sobre los antecedentes de los usuarios.

13.- En caso de conflicto, se aplican las leyes de California y se somete al usuario a arbitraje individual (sin posibilidad de acceder a tribunales a menos que se haya negado el sometimiento al arbitraje). Algo nulo para los usuarios europeos, pero que sí afecta a los norteamericanos, por ejemplo.

En conclusión, Pokémon GO es bastante razonable en materia de términos y condiciones. Presenta dos detalles dignos de mención: a) la preocupación por el consentimiento de los padres en usuarios menores de 13 años y b) la posibilidad de negarse a la recopilación y uso de los datos personales recopilados (aunque en la práctica eso casi inutilice el juego). También se nota interés en regular detalladamente los micropagos y el (no) comercio de ítems virtuales por bienes y servicios reales (que en todo caso ya está ocurriendo). La participación de Google, aunque sea menor, quizá pueda “inquietar” algo en cuanto a la explotación de los datos personales y la privacidad del servicio. Sin embargo, a día de hoy no hay ninguna gran alarma en ese sentido. Y el uso no comercial del servicio va a dar más de un dolor de cabeza, teniendo en cuenta el potencial del servicio para el pequeño comercio.

En resumen, tenemos fenómeno del año entre manos. Disfruten y háganse con todos.

Gotta catch all your rights and obligations too

Pokémon GO went live less than two weeks ago in just a few countries, but it has already become one of the phenomenons of the year. In fact, it already is the biggest mobile game ever in USA and it is quickly approaching the level of use of services such as Google Maps and Snapchat. All of that in less than two weeks.

The concept is classic Pokémon: you gather the best Pokémon to train them later and compete against different trainers and through tournaments around the world. The huge difference here is that the world is not virtual anymore, now the real world is the playground.

The thing is that thanks to augmented reality, the Pokémon do not live in a virtual world now. Instead they live and walk in the real world. For example, the garden of your neighbor. Through our mobile devices we can locate them (the camera + geolocation), catch them, train them and then compete against the rest of the world.

That means that the immersion and interaction goes through the roof, because to catch the Pokémon you have to physically move to the places where the app points out that they are living. Something that has generated more than a few complaints from players with disabilities, whose options to play get very limited.

When all the planet is the game board and the player needs to move around to play, plenty of things can go wrong. That’s why we already have plenty of crazy stories since the launch of the game: 

• Places banning the hunting of Pokémon
• Infidelities being discovered through Pokémon GO
• The Mayor of Rio asking for the use of the game during the Olympic Games
• Or cops and robbers taking advantage of the excursions of the players

And that’s just the beginning…

But let’s go to the point, what do the terms and conditions of Pokémon GO say? Well, its Terms of Service, Privacy Policy, Copyright Policy and Trainer Guidelines have some very interesting aspects.

Let’s go for it!

13 details about its terms and conditions

1.- The agreement is signed with Niantic Labs, a company born within Google that would become independent in 2015. That year, and with the announcement of the development of Pokémon GO, Google, Nintendo and The Pokémon Company invested in the growth of the company. So now the three of them are part of Niantic Labs.

2.- The use of Pokémon GO is personal and no commercial. Therefore, all those small and medium businesses interested in using it to gain new clients would be infringing its terms and conditions. In any case, the sponsored locations are coming.

3.- To play it you have to be at least 13 years old. Having said that, the minors under 13 years need that their parents register at The Pokémon Company International through the Trainer Club. During that process, the username, email and date of birth has to be filled. That way the parents can consent. In addition, if you are a USA resident, you have to verify that you are the father o mother of the minor through an specific process. Then, if the parents want to remove the consent for an account of a minor under 13 years, they can use this form.

4.- If you want to access the service you need a Google, Facebook or Pokémon Trainer Club account.  The required personal information will be gathered from the data of these accounts (for example the email). Then the Pokémon GO account can be created. In the case of a Trainer Club account, the date of birth, name and surname will also be needed. The access to the service through third party accounts, such as Google, created some uproar in relation to the privacy of Pokémon GO. The reason was that using a Google account implied full access to the content of it (that meant way more than just the email). In any case, the bug was fixed a few days later.

5.- The data compiled by the game, through the different phases, is: username or real name (according to the option chosen by the user), country, language, the data gained through cookies and beacons (such as web traffic and aggregate use), the IP, the user agent, the browser used, operating system, web of origin, search terms, time invested, clicked links and something very important from a privacy point of view, the location (through GPS, Wifi triangulation or phone towers).

6.- Who has access to the data and how it is shared? Let’s take a look to an important privacy aspect:

a) With The Pokémon Company (the International too) personal data is shared (from adults and minors under 13 years old) to solve any problem produced during the register process. The Pokémon Company International also compiles the data about the consent given by the parents in relation to minors under 13 years registered on the game.

b) With service providers that allow the proper functioning of the game (for example, web hosting), personal data is shared (from adults and minors under 13 years) just to provide the service.

c) The non-personal data from adults (the minors under 13 years are excluded) is shared for research, analytics, demographic profiling and other similar purposes.

d) If a third party acquires the company, personal data (from adults and minors under 13 years) could be shared. In any case, a notice would be sent 30 days prior to the exchange, so the user could oppose to it.

e) With governments, law enforcement officials or private parties to comply with the law, for example a legal process.

f) In any case, you can refuse further collection, use or disclosure of your personal data (from minors under 13 too). For example, by preventing that the personal information of an adult or minor user ends up in USA (the place where the personal data is transferred and processed). Something like that can be requested at: pokemongo-privacy@nianticlabs.com However, that possibly means that the access and use of Pokémon GO gets very limited. Therefore, it is more like playing to the gallery…

7.- The content shared by the user through the app is licensed to Niantic Labs perpetually, on a non-exclusive and irrevocable way, with the option for a possible transfer and/or a sublicense, free of charge and on a worldwide scale. So, the content is shared veeeery generously.

8.- The Pokémon obtained can be exchanged for others but within the service and not for virtual money, real money, real goods or real services. In any case, there are already users taking advantage of the business side of Pokémon GO (for example, “taxi” services to carry someone to the location of a Pokémon).

9.- The game obviously includes micropayments, but they have to be done by 18 years old users or users under that age but with parental consent to make the purchase. The micropayments allow refunds, but only until the purchase is completed. Once is done, there is no option.

10.- If a Pokémon GO account is not used during 1 year, the account is deleted and everything related to it will be lost. In any case, a closed account will be kept “for a reasonable amount of time from a commercial point of view”. If the virtual money or in-game content is expected to be interrupted or changed some way, a notice will be sent 60 days in advance.

11.- There are plenty of forbidden conducts, but taking into account the kind of game that Pokémon GO is, there is an important one: you should not try to access a place or location where you don’t have the right to enter. It is kind of obvious, but definitively something to remember because there are already places that are banning the access to Pokémon GO players. In fact, if you don’t want your home or business appearing in the map of Pokémon GO as a gym, Pokéstop or whatever, Niantic Labs is providing a form just for that. The form can also be used to alert about dangerous or inappropriate places shown on the map as events or items.

12.- The online and offline communications of the user with different players, are entirely its responsibility. In fact, Niantic Labs says that they don’t investigate or ask about the records or precedents of a user.

13.- If there is a problem, the laws from California will the be ones to take into account. In addition, unless the user opts-out of it, it is subject to an individual arbitration without an option to go to court. Both conditions are unfair according to European law, but they would be applicable to a user from USA, for example.

In summary, Pokémon GO is quite reasonable on the terms and conditions subject. It has a couple of details worth mentioning: a) the concern about the consent from the parents on users under 13 years and b) the possibility to refuse the collection or use of the gathered personal data (although in practice it limits a lot the game). Another interesting point is the detailed regulation of the micropayments and the (non) commerce of virtual items for real goods and services (although that is already happening). Google being part of Niantic, although on a small scale, could cause some concerns about the use of the personal data and the privacy of the service. However, nowadays there isn’t any big red flag in this sense. Finally, the non commercial use of the app is going to cause more than a few troubles, seeing the potential for small and medium services.

In short, there is no doubt that this is one of the phenomenons of the year. So, have fun and catch them all.

Nintendo hizo historia ayer estrenando el que es su primer juego para dispositivo móvil, Miitomo.

Una nueva andadura para el gigante japonés de los videojuegos en una categoría que casi inventaron, los videojuegos portátiles, pero que debido a los smartphones había comenzado a convertirse en su mayor amenaza.

Miitomo es un juego/app gratuito, aunque con micropagos, que permite crear un avatar (un Mii) con el que se puede jugar, cambiar de ropa o hacer fotos, a la vez que permite comunicarse con los Miis de nuestros amigos. La particularidad es que el Mii pregunta al usuario algo, éste le responde y el Mii comparte esa respuesta con los Miis de sus amigos. Por tanto la app es un poco videojuego, red social y sistema de mensajería.

Como se ha comentado, si bien la app es gratuita, pueden comprarse objetos como nueva ropa, que se pagan con las monedas virtuales del propio juego. Y éstas pueden obtenerse desde el juego a cambio de información (responder preguntas de los Mii o comentando las respuestas de los amigos), jugando a minijuegos o adquiriéndolas con dinero real.

Además, siendo Nintendo una marca muy asociada a los niños, es interesante indicar que Miitomo no está recomendada para menores de 13 años.

Por tanto, siendo el primer juego de Nintendo para smartphones y además, con micropagos, parece buena idea echarle un vistazo a su privacidad.

¡Vamos allá con los 13 detalles!

La privacidad de Miitomo

1.- Se recopilan datos como: el país de residencia, el sexo, la fecha de nacimiento, la dirección IP y MAC, el número de serie, el número de teléfono, la configuración de la conexión a Internet, ajustes del dispositivo como el idioma o la resolución de pantalla.

2.- Nintendo también podrá acceder a información que contiene el dispositivo, como la agenda de contactos o la ubicación. Pero se informaría sobre ello.

3.- Si se hacen compras, Miitomo permite micropagos, se recopilan datos como el historial de compras, uso de los artículos adquiridos o el registro de licencias.

4.- Durante el uso del juego, se recopilan datos como: el apodo, perfil y apariencia del Mii creado, los códigos alfanuméricos que identifican al personaje y los personajes de personas con las que haya interactuado, el contenido creado y cuándo se estaba o no online.

5.- Nintendo también recopila datos como las actividades realizadas en el juego, las funciones usadas, la hora a la que se juega, así como el nivel y puntuación obtenidos.

6.- Es posible vincular la cuenta creada en Miitomo con Facebook o Twitter, para así encontrar más amigos. En ese caso, Nintendo recopila y fusiona los datos de un lado y otro.

7.- Como se ha dicho antes, no se recomienda el uso de Miitomo en menores de 13 años. Es decir es una app para adolescentes (por si hay dudas, basta ver el primer anuncio hecho para EEUU).

8.- La múltiple información recopilada podrá usarse para evitar actividades potencialmente ilegales, cumplir Nintendo con sus obligaciones legales o ejercer los derechos que le correspondan.

9.- Las respuestas compartidas con los Miis de nuestros amigos, únicamente pueden ser vistas por nuestros amigos. Los comentarios que se hagan de esas respuestas podrán verlos: quien hizo el comentario, quién lo recibió y los amigos de quien lo recibió.

10.- Puedes borrar tu cuenta en Miitomo, lo que implicará la desaparición de tus datos de usuario, tus respuestas, comentarios e incluso monedas obtenidas (a no ser que hubieras vinculado Miitomo a una cuenta Nintendo).

11.-Si te haces una Miifoto, aunque tengas vinculado tu Facebook y Twitter a Miitomo, no se publicarán automáticamente en esas redes sociales. Ahora bien, si tú decides publicarla y luego eliminarla, únicamente se quitaré de Miitomo. Si la quieres eliminar de las redes sociales en las que la compartiste, deberás ir una por una.

12.- La información recopilada se podrá usar de forma agregada para realizar análisis demográficos y estadísticos. También podrá Nintendo usar esos datos para estudios de mercado y marketing, aunque en cualquier momento podremos impedir ese uso.

13.- Los datos recopilados se podrán compartir con Nintendo of Europe y todas sus sucursales, así como Nintendo of America.

En conclusión, la primera app de Nintendo para móvil es una mezcla entre videojuego y red social basada en sus famosos Mii, enfocada al público adolescente, con micropagos y un concepto de la privacidad bastante razonable y lógico. Ahora bien, no deja de ser curioso que se ganen monedas para micropagos mientras más información demos a nuestro Mii…

The first game from Nintendo for mobile

Yesterday Nintendo made history with the worldwide release of its first game for mobiles devices, Miitomo.

A new path for the Japanese company in a category that they almost invented, the portable video game console, but where the landscape has really changed with the appearance of smartphones.

Miitomo is a free game/app, although with micro payments, that allows the user to create an avatar (a Mii) than can be used to play mini games, change clothes, take pictures and communicate with the Miis of our friends. The distinctive feature here is that the Mii that I create will ask me something, I will respond to it and then that answer will be shared with the Miis of my friends. Therefore, the app is a mixed between a video game, a social network and messaging service.

As has already been said, although the app is free, you can buy new content such as clothes. How? Well, you buy this content using the virtual currency from the game. Those coins can be gained by playing mini games, answering questions from the Miis, commenting the answers of your friends or buying them with real money.

On the other hand, and being Nintendo a brand very much associated with children, is interesting to point out that you must be at least 13 years old to play Miitomo.

Therefore, being this the first game from Nintendo for smartphones, and with micro payments, it sounds like a good idea to take a closer look at its privacy.

Let’s go with those 13 details!

The privacy of Miitomo

1.- Some of the data that the app collects: your country and gender, your IP and MAC address, the serial number, telephone number, your Internet service configuration or device settings such as language or the display resolution.

2.- Nintendo could also have access to data such as your contacts or location. Although the user would be informed about that.

3.- If you buy something, after all Miitomo has in-app purchases, the app collects data such as the things that you have bought, how those things are used or the register of licenses.

4.-Some of the data that the app collects while your are using it: the nickname, profile and appearance of your Mii, the alphanumeric codes that identify your character and the ones from people who has interacted with you, the user content created and when you were or not online.

5.- Nintendo also compiles data from your activity during the game, the used features, the time of the day when you are playing, as well as your level and score.

6.- You can link your account of Miitomo with your Facebook or Twitter, so you can find your friends easily. In that case, Nintendo will compile and merge the data gathered from both accounts.

7.-As has already been said, you must be at least 13 years old to use Miitomo. So, this is an app for teenagers or millennials (if there were any doubts, just check the first ad for the app in USA).

8.- The huge amount of information collected by Nintendo can be used to avoid activities that could be illegal, to comply with its legal obligations or to exercise its rights.

9.- The answers that we share with our friends can only be seen by them. When you comment an answer, that can be seen by: the user who made the comment, the user who received it and his/her friends.

10.- You can delete your Miitomo account. That implies that the data from your account, your answers and even your coins will disappear (unless your Miitomo account is linked to a Nintendo account).

11.-If you take a Miifoto, even if your Facebook and Twitter are linked to your account, those photos won’t be automatically published there. Having said that, if you publish the photo but later you want to delete it, that picture will just disappear from Miitomo. If you want to delete it from the social networks where you also shared it, you’ll have to go one by one.

12.- The information collected may be used in aggregated form for demographic or statistical analyses. Nintendo can also use that information for market research and marketing studies. In any case, we can block that use at any moment.

13.- The data compiled we’ll be shared with Nintendo Europe and all its subsidiaries, as well as Nintendo America.

In short, the first app from Nintendo for smartphones is a mix between video game and social network based on the popular Miis. It focuses on the teenager or millennial audience, it includes micro payments and a concept of privacy reasonable enough. Having said that, it’s really interesting how the more info you give to your Wii, answering its questions, the more coins you gain to pay for your goods…
